1. Acceptance of Terms

By accessing or using NibbleCal ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via an in-app notice.

2. Service Description

NibbleCal is an AI-powered food tracking and kitchen management application that provides:

  • Photo-based food identification and nutritional estimation
  • Manual and voice-based food logging
  • Barcode scanning for product nutrition lookup
  • Kitchen inventory management
  • AI-generated recipe suggestions based on available ingredients
  • Nutrition goal setting with TDEE/BMR calculations
  • Nutrition analytics and trend tracking
  • Shopping list management

NibbleCal is not a medical device, dietary supplement, or professional nutrition service. All nutrition data, calorie estimates, and recipes are provided for informational purposes only. See our Disclaimer for details.

3. Eligibility

You must be at least 16 years of age to use NibbleCal. By creating an account, you represent that you meet this age requirement.

4. Account & Authentication

  • Accounts are created using a valid email address via passwordless magic link authentication.
  • You are responsible for maintaining access to your email account.
  • Each person should maintain only one account.
  • You must not share your session or allow others to access the Service through your account.
  • Notify us immediately at info@nibblecal.com if you suspect unauthorised access to your account.

5. Household Feature

NibbleCal supports multi-user households. When you join or create a household:

  • Inventory, shopping lists, and recipe data are shared among all household members.
  • Any household member can add, modify, or remove shared items.
  • Your personal nutrition goals and food logs remain private to your account.
  • The household owner can manage membership and roles.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access other users' accounts or data
  • Use automated tools, bots, or scrapers to access the Service
  • Upload malicious content, viruses, or harmful code
  • Circumvent rate limits or abuse the AI processing features
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to train AI or machine learning models without our written consent

7. AI-Generated Content

NibbleCal uses artificial intelligence to generate recipes, identify food items, estimate nutritional values, and provide analytics. You acknowledge that:

  • AI output is approximate. Calorie counts, macro breakdowns, and food identifications are estimates and may contain errors.
  • Recipes are suggestions. AI-generated recipes have not been tested in a kitchen and may not account for all safety considerations.
  • Allergen detection is not guaranteed. AI may fail to identify allergens in food photos or generated recipes. Always verify ingredients if you have food allergies.
  • You use AI features at your own risk. We do not warrant the accuracy, completeness, or safety of any AI-generated content.

8. Intellectual Property

8.1 Our Property

The NibbleCal name, logo, user interface, design, and underlying software are the property of NibbleCal or its licensors. All rights reserved.

8.2 Your Content

You retain ownership of photos, text, and other content you upload to NibbleCal. By uploading content, you grant us a limited licence to process, store, and display it within the Service as needed to provide its features (e.g. sending a photo to an AI service for food identification).

8.3 AI-Generated Recipes

Recipes generated by the Service are provided to you for personal use. You may share them freely. We do not claim ownership of AI-generated recipes.

9. Service Availability

We strive to keep NibbleCal available, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Maintenance or updates
  • Third-party service outages (AI providers, database, email)
  • Circumstances beyond our control

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

10. Pricing, Subscriptions & Billing

10.1 Free & Paid Tiers

NibbleCal offers a free tier with core features (manual food logging, macro & calorie tracking, nutrition goals, analytics dashboard, inventory management, shopping lists, barcode scanning, recipe browsing) and a paid subscription (NibbleCal Pro) that unlocks premium AI features including AI photo recognition, voice logging, AI food correction, AI recipe generation, and shopping list scanning.

10.2 Free Trial

New subscribers receive a 7-day free trial of NibbleCal Pro. During the trial, you have full access to all paid features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.

10.3 Billing

  • Subscriptions are billed on a recurring basis (monthly or as displayed at checkout).
  • Payments are processed by Polar (polar.sh), our third-party payment processor. By subscribing, you also agree to Polar's Terms of Service.
  • All prices are displayed inclusive of applicable taxes unless otherwise stated.
  • You can manage your subscription and payment methods through the Polar customer portal, accessible from your Settings page.

10.4 Cancellation & Grace Period

  • You may cancel your subscription at any time through the billing portal in Settings.
  • Upon cancellation, you retain access to paid features for a 7-day grace period after your current billing period ends.
  • After the grace period, your account reverts to the free tier. No data is deleted.

10.5 Refunds

Refunds are processed by Polar in accordance with their refund policies. If you believe you have been charged in error, you can request a refund through the Polar customer portal (accessible from Settings) within 48 hours of the charge, or contact us at info@nibblecal.com and we will assist you. No charge is made during the free trial period.

10.6 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period. If you do not agree to the new price, you may cancel before it takes effect.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • NibbleCal is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
  • We do not warrant that AI-generated nutrition data, calorie estimates, or recipes are accurate, complete, or suitable for any particular dietary or health purpose.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • We are not liable for any adverse health outcomes resulting from following nutrition data, calorie targets, or recipes provided by the Service.
  • Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim (or zero if the Service is free).

Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by applicable law.

12. Indemnification

You agree to indemnify and hold NibbleCal harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

13. Termination

  • By you: You may stop using the Service at any time. You can delete your account and all associated data from the Settings page. If you have an active subscription, cancelling your account will also cancel your subscription.
  • By us: We may suspend or terminate your account if you violate these Terms, with notice where practicable. If you have an active paid subscription and we terminate your account without cause, we will refund any prepaid amounts for unused subscription periods.

Upon termination, your right to use the Service ceases. When you delete your account, it enters a 30-day soft-delete period during which you can cancel the deletion by signing back in. After 30 days, all your data is permanently and irreversibly deleted. Further details are in our Privacy Policy.

14. Governing Law & Disputes

These Terms are governed by the laws of the European Union and the applicable national law of your country of residence within the EU/EEA. Any disputes shall be resolved in the courts of your country of residence, in accordance with EU consumer protection rules.

You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
